Website Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website at cupertinofc.org (the “Site”) operated by Cupertino Sports and Education Inc., doing business as Cupertino FC (“Cupertino FC,” “we,” “us,” or “our”), a 501(c)(3) nonprofit organization. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Use of the Site

The Site is provided for informational purposes related to Cupertino FC’s youth soccer programs, events, and activities. You may use the Site for lawful purposes only. You agree not to: use the Site in any manner that could damage, disable, or impair the Site or interfere with any other party’s use; attempt to gain unauthorized access to any portion of the Site, its servers, or any connected systems; use any automated means (bots, scrapers, spiders, or similar tools) to access or collect information from the Site without our written permission; use the Site to transmit unsolicited advertising, spam, or promotional material; or misrepresent your identity or provide false information on any form.

Age Requirement and Parental Responsibility

The Site is directed at adults. By submitting any form on the Site, you represent that you are at least 18 years of age or are a legal guardian submitting information on behalf of a minor. Parents and guardians are responsible for the accuracy and completeness of all information submitted about their child.

Forms, Submissions, and Embedded Agreements

When you submit information through forms on the Site (including the contact form, tryout interest form, competitive team registration, Adaptive Soccer registration, volunteer signup, or email list signup), you agree to provide accurate and complete information.

Certain forms contain or reference separate agreements, including but not limited to: Tryout Participation Agreement; Photo/Video Release; Adaptive Soccer Player Participation Agreement; Adaptive Soccer Volunteer Agreement; Adaptive Soccer Photo/Media Release; Competitive Team Enrollment Policy; and Camps and Recreational Enrollment Policy. These agreements have their own terms and conditions. By checking the applicable acknowledgment boxes and submitting the form, you agree to be bound by those separate agreements. Copies of these agreements are available on request by contacting admin@cupertinofc.org.

Additional Policies

Participation in Cupertino FC programs is also subject to our Non-Discrimination Policy, Cancellation Policy, and Code of Conduct, each of which is available on the Site. These policies are incorporated by reference into these Terms to the extent they apply.

Fee Calculator

The competitive team registration form includes a fee calculator that estimates registration fees based on your selections. This calculator is provided for reference and convenience. While we strive for accuracy, Cupertino FC reserves the right to correct any errors in fee calculations. In the event of a discrepancy, the correct amount will be communicated to you before payment is due.

Registration and Payment

No payment information (credit card numbers, bank account numbers) is collected on this Site. When you submit a registration form, you will receive instructions to complete payment through your selected method (Zelle, check, or PayPal). Camp and recreational program payments are processed through Active Network. All payment transactions occur on external platforms subject to their own terms and privacy policies.

Third-Party Links and Services

The Site contains links to third-party websites and services, including Active Network (camp and recreational registration and payment), PayPal (competitive team payment processing), league and governing body websites (CalNorth, NorCal Premier, US Club Soccer), and social media platforms. These links are provided for convenience. Cupertino FC does not control and is not responsible for the content, privacy practices, terms of use, or availability of any third-party sites or services. Your use of third-party sites is at your own risk and subject to their respective terms.

Intellectual Property

All content on the Site — including text, graphics, logos, images, photographs, and software — is the property of Cupertino Sports and Education Inc. or its content suppliers and is protected by applicable copyright and trademark laws. The Cupertino FC name, logo, crest, and related marks are trademarks of Cupertino Sports and Education Inc. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent, except that you may print or download content for personal, non-commercial use related to your family’s participation in Cupertino FC programs.

Programs and Activities

The Site provides information about Cupertino FC’s soccer programs, including competitive teams, camps, recreational training, and Adaptive Soccer. Cupertino FC reserves the right to modify, reschedule, suspend, or cancel any program, session, event, or activity at any time due to weather, field availability, insufficient enrollment, public health concerns, safety considerations, or other circumstances. We will make reasonable efforts to notify registered families of material changes.

Information about programs, schedules, fees, and availability is subject to change. While we strive to keep the Site current, we do not guarantee that all information is accurate or up to date at all times.

Assumption of Risk and Physical Activities

While these Terms govern your use of the Site (not physical participation in programs), you acknowledge that youth soccer and related athletic activities involve inherent risks of physical injury. Participation in any Cupertino FC program is subject to separate waivers, participation agreements, and releases of liability that are presented during the registration process. These Terms do not limit or supersede the terms of any such waiver or agreement.

Disclaimer oaf Warranties

The Site and its contents are provided on an “as is” and “as available” basis. Cupertino FC makes no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, suitability, or availability of the Site or any information, content, or materials on the Site. To the fullest extent permitted by California law, Cupertino FC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by California law, Cupertino FC and its officers, directors, employees, volunteers, coaches, agents, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site, including but not limited to errors or omissions in Site content, loss of data, or any injury or damage resulting from reliance on information provided on the Site.

Indemnification

You agree to indemnify, defend, and hold harmless Cupertino Sports and Education Inc., its officers, directors, employees, volunteers, coaches, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms; (b) your submission of false, misleading, or inaccurate information through any form on the Site; or (c) your use of the Site in a manner not authorized by these Terms.

Dispute Resolution

If you have a dispute with Cupertino FC arising from your use of the Site, you agree to first attempt to resolve it informally by contacting us at admin@cupertinofc.org. We will make good faith efforts to resolve the matter within 30 days. If the dispute cannot be resolved informally, either party may pursue resolution in a court of competent jurisdiction in Santa Clara County, California, subject to the governing law provision below.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Santa Clara County, California, for the resolution of any dispute arising under these Terms.

Accessibility

Cupertino FC is committed to making the Site accessible to all visitors, including individuals with disabilities. If you experience difficulty accessing any content on the Site, please contact us at admin@cupertinofc.org or call 408-673-8414, and we will make reasonable efforts to provide the information in an accessible format.

Modifications

We may revise these Terms at any time by posting updated Terms on this page with a new effective date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Waiver

The failure of Cupertino FC to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at a later time.
